1. Agreement & Services
This Terms of Service ("TOS") is a binding legal contract between CNSERVERS LLC ("CNservers", "we", "us") and you ("Customer", "User"). By accessing or utilizing the infrastructure, network, or server services provided by CNservers, you agree to comply with all terms herein.
CNservers provides high-performance infrastructure. While we manage the underlying hardware and global network routing, you are solely responsible for the software, data, and security configurations within your provisioned environment.
2. Billing, Refunds, and Renewals
All services are provided on a pre-paid basis. Service provisioning begins only after successful payment verification.
- Refund Policy: All sales are final. Customers are not entitled to any refund more than 48 hours after the initial service activation.
- Renewal Requirement: To prevent service interruption, renewal fees must be paid at least 3 days prior to the billing cycle expiration.
- Service Modification: CNservers reserves the right to adjust service pricing or features; however, such changes will not affect active billing cycles already paid for.
3. Acceptable Use Policy (AUP) & Global Compliance
CNservers operates data centers globally (including but not limited to the USA, Hong Kong, Japan, and Singapore). You agree to use our services only for lawful purposes and must comply with:
- Local Laws: You must adhere to the specific laws and regulations of the jurisdiction where your server is physically located (e.g., California state laws for LA-based servers, HKSAR laws for HK-based servers).
- Prohibited Activities: Strictly forbidden activities include hosting child exploitation material, extreme violence, unauthorized political or religious propaganda, illegal gambling, malware distribution, and phishing.
- Spam: Sending unsolicited bulk email (SPAM) or hosting spam-related support services is strictly prohibited.
Violation of this AUP grants CNservers the right to immediately terminate services without a refund.
4. Network Security & DDoS Mitigation
CNservers operates a premium 20Tbps global backbone and utilizes localized scrubbing nodes near major data center hubs to provide high-capacity DDoS mitigation.
- Outbound Attack Ban: You are strictly prohibited from using our network capacity to launch outbound DDoS attacks, network scanning, or ARP spoofing. Breach of this clause results in permanent account termination.
- Infrastructure Protection: If an inbound attack against your server exceeds our localized mitigation thresholds or threatens the stability of our global routing, we reserve the right to temporarily null-route or suspend your service to protect other customers.
5. Data Retention & Backups
You are solely responsible for your own data backups. CNservers does not guarantee data integrity and assumes no liability for data loss due to hardware failure, software bugs, or user negligence.
- Post-Expiration Retention: Upon service expiration or termination, CNservers will retain your data for exactly one (1) natural day as a grace period.
- Permanent Destruction: After this 24-hour period, all data will be permanently and irreversibly destroyed from our systems.
6. Limitation of Liability
In no event shall CNservers' total liability for any claim arising from this agreement exceed the total amount of service fees paid by you for the specific affected service during the one (1) month preceding the incident.
We are not liable for downtime caused by routine maintenance, network congestion outside our backbone, or Force Majeure events (natural disasters, war, government intervention).
7. Governing Law & Global Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon, USA, regardless of the physical location of the server infrastructure.
While our infrastructure must comply with localized physical regulations (e.g., California, Hong Kong, or Tokyo), all contractual and billing disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in Clackamas County, Oregon.
